National Anti-Corruption Program

1. Introduction
An evident and critical problem, of which exists in any transitional society, is the mobilization of all the strengths of society in order to resolve problems; this is a sign of democratic maturity. In this context it is incredible that there is an actual search for paths towards close cooperation between state and social institutions as well as business ones.

A great part of Ukrianian and international specialists note, that corruption belongs to one of the main problems in the development of Ukraine, and is one of the greatest barriers on the road to the integration of Ukraine into the world partnership and the development of civic society.

In Ukraine corruption is so widespread, that not only once it has been the theme of discussion of meetings of leading world publications and at inter-governmental meetings. It is a widescale phenomenon, which creates a realistic political problem for the entire nation, directly influencing internal processes and external relations and creates all pre-conditions for a social explosion without preconceived concequences.

Disturbed by such a situation a group of NGOs, members of the “Freedom of Choice” Coaltion of NGOs of Ukraine has come forth with the initiative to collectively join forces and capabilities in order to try to resolve the problem of corruption and has initiated the National Anti-Corruption Program (hereafter, NAP).

During the transitionary phase of Ukrainian society there has appeared a critical mass of problems, that are an inhibitor to development and a real threat to national interests. It is responsibility of the social sector to address these problems; and at the current time, this sector is ready to take on the challenge.


Reasons and Pre-conditons for Corruption

Participants of the Program consider that pre-conditions of corruption are:
· problem of a shadow economy;
· imperfect legal base;
· weak judicial system;
· the dependence of the mass media;
· socio-economic and ethical problem of civil servants;
· lack of knowledge of rights by citizens;
· limited availability of information on government decisions and underdeveloped process of of their making and enacting;
· the indifference of citizens towards the problem of corruption.

A strategic direction for the stemming the pre-conditions of corruption and its neutralization is the coherent democratization in all spheres of social life, development of citizen understanding and activity in the general context of the building of a democratic state. Democratization, openness of the government, transparency and understanding by citizens of government decisions, activity of the executive bodies, development of a civic society are the most important in resolving the problem of corruption.


2. General Situation


The National Anti-Corruption Program is a system of concrete focused activities and projects of NGOs in Ukraine, aimed at curbing and lowering the level of corruption.

The NAP is an independent and multipart system (Program) of activities of NGOs of Ukraine, that forsees utilizing a concrete number of measures both quantitative and qualitative during its realization.

The main task of the NAP is to change society’s attitude to the problem of corruption and the liquidation of the pre-conditions for its existence.

The form and mechanism for the realization of the Program is oriented towards the maximal cooperation with the current system of government structures for combating corruption and utilizing the current anti-corruption laws. The NAP differentiates itself strategically and cooperatively with the system of anti-corruption activities that are listed in the Concept of the Battle with Corruption for 1998-2005, that was decree № 367/98 of the President of Ukraine on April 24, 1998.

The method of effective cooperation and the realization mechanism of social partnership in the Program are in correspondence to the classified forms of corrupt activities (Appendix 1). The NAP operates using conforming terminology and an understood apparatus.

In agreement with the indicated term “corruption”, that was described in the Law of Ukraine “On the Battle with Corruption” (Resolution of the Parliament of Ukraine №357/95-VR dated 05.10.95 (Appendix 2)) and in the framework of the realization of the NAP we understand this term to have a broader meaning. Particularly the participants in the NAP consider, that the term “corruption” can be applied to all spheres of societal life and in regard to its relationship to the activities of government, business and civic sectors. Under the term corruption the NAP understands the wide spectrum of abuses of power and illegal activities in the non-government sector, the activities of the mass media and the political sphere.

The NAP foresees the achieving both short and long term goals. An important task of the NAP is to achieve visible results quickly within the realization of the Program.


Conditions for Realizing the Program

The Program is a nationwide initiative by NGOs, individual citizens, administration, government, business people, trade unions and the mass media.

The Program is to be conducted on the base of the “Freedom of Choice” Coalition of NGOs of Ukraine.

In the realization of the Program the participants are NGOs throughout Ukraine who signed the Memorandum on Cooperation to resolve the problem of corruption.

The Program foresees to achieve indicators of success concrete, quantitative and qualitative.

The Time frame for the Program is 2 years.

It is possible to join the Program during the entire duration of its realization.

The basis of the Program is volunteerism and accountability of all of its participants.

Cooperation amongst participants in the Program happens on the basis of consensus between the participants in a pluralistic atmosphere of cooperation.

The Program does not put forth as one of its tasks of revealing facts of corruption or the creation of procedures of punishment.

All organization-participants in the Program cooperate closely amongst themselves and develop a joint plan of activities.

As a goal of coordination of activities of the organization-participants of the Program, and to ensure its realization, an effective mechanism of financing and the developing of a positive image a Coordinative Council of the Program should be formed as well as an Executive Committee of the Program. Members of the Coordinative Council are representatives of the organization-participants of the Program.

The Program is realized through the close cooperation with government structures at various levels as well as with business, trade unions, mass media and other interested structures.

3. Goals and Tasks of the Program


The goal of this Project is to realize a comprehensive nationwide NGOs campaign aimed at curbing and lowering the level of corruption in Ukraine.

The main task for realization of the Program is to resolve the wide spectrum of problems in the most evident spheres of social life, particularly:

Socio-political
· Conducting of activities focused on changing the attitudes of society regarding the problem of corruption and educating the younger generation on new moral and ethic principles;
· Conducting a comprehensive program of educational activities in regard to the rights and freedoms of citizens;
· Ensuring transparency in the activities of the authorities and openness in their interaction with citizens;
· Ensuring transparency of the financing of political parties during election campaigns;
· Realizing activities and publications that are focused on educating citizens regarding procedures of law and the responsibilities of government structures;
· Formation of a system of social partnership between government structures at all levels, businesses and the civic sector and the mass media for resolving the problem of corruption;
· Support administrative and deregulation reforms;
· Public support of civil servants, who have experienced pressure and consequences of corruption;
· Stimulate an attitude of impatience in regard to corruption and encourage citizens to persue their rights employing legal methods;
· A public demonstration and explanation of the criteria and cost of corruption;
· To unite businesses, mass media, trade unions to actively stand against corruption.

Informational
· In favor of the openness and independence of the mass media;
· Encourage the conduct of investigative journalism in regard to the facts of corruption;
· Form a mechanism of civic protection of the mass media, that research and publish information on corruption and corrupt activities;
· Form a system of widespread distribution of information on corrupt activities;
· Widely inform the public about evidence of corrupt events and the development of a rating system of corruption based on input from citizens;
· Form a network of information consultative services for citizens;
· Widespread publication of precedents and successful activities that are focused on battling corruption.

Economic
· In favor of conducting transparent process of privatization and transfer of management of state and communal ownership;
· In favor of the transparent process of deregulation of the market in Ukraine;
· Elaboration of an effective procedure to engage society in the budgetary process;
· Increase the level of transparency in the formulation of state and municipal budgets;
· In favor of conducting tax reforms and explanating the importance of reducing tax pressure;
· Increase transparency and simplify the tax system and the decisions of departments related to taxation;
· In favor of transparent rules and procedures of state purchases;
· Increase the role of public market institutions (exchanges, tenders, auctions).


Normative-Legal
· In favor of systematic changes to anti-corruption legislation, its analysis and indications of zones of risk of corruption;
· Create the institution of public defenders (ombudsmen);
· In favor of changes to legislation that are aimed at ensuring the transparent activities of government and the mass media;
· In favor of specific regulations for authorized civil servants and their functions;
· Formation of a clear system of attestationanal competition for job positions in the civil service;
· Ensure the transparency of the procedures in regard to tenders and activities of privatization;
· In favor of reforms to the judicial system and increase the faith of citizens in the system;
· In favor of the conducting a procedure that limits the direct contact of civil servants and citizens;
· Formation of moral-ethical norms for the activities of state, business and civic sectors, and development of legislation that conforms to these norms.

Analytical
· Analysis of research on the nature of corruption on the real stage in the development of society;
· Organization of civic monitoring of the implementation of Government decisions and Parliament from the view point of their influence on increasing/decreasing the possibilities for corruption;
· Organization of civic monitoring of the implementation of municipal governments from the view point of their influence on increasing/decreasing the possibilities for corruption;
· Adapting handbooks and aids of USAID and Transparency International “National System of Integrity” for Ukrainian conditions and develop a national handbook;
· Conducting appropriate sociological research;
· Conducting research and academic-practical activities that research the problem of corruption and create the mechanisms for stemming it and that work against it.

International
· Employ international standards for behavior of civil servants and procedures for making decisions;
· Informing the international community about the progress of Ukraine in its increasing transparency of government structures;
· Employ international experience in fighting corruption in regards to practical implementation through NGOs and the conducting of educational-informational activities for state and business structures;
· Inform the international community about the dynamics tied to the problem of corruption with the intent of turning attention to the need for assistance from international organizations in solving this problem, and to improve the image of Ukraine in the international community and be in favor of the development of an active partnership;
· To distribute and conduct the recommendations of authoritative international organizations in regard to mechanisms of work of government structures and to realize anti-corruption activities.


4. Mechanism of realization of the program


Methods of realizing the Program

A priority of the Program is the direct work with citizens located in the regions of Ukraine.

The Program will be realized in the format of individual projects of organization-participants. Within the framework of the Program coordination of the projects will take place.

Within the framework of the realization of the Program there will be a series of systematic meetings between participants in the Program and meetings of the Coordination Council of the Program.


Projects that will be realized within the framework of the Program will be realized as two groups:
- Regional
- National

Realization of Regional projects are focused on:
- direct contact with citizens;
- formation of informational consultative centers for citizens;
- cooperation with local organs of the government authorities to ensure the process of public politics and transparency in their activities;
- cooperation with business structures and government organizations;
- creation and dissemination of educational material;
- active cooperation with local mass media, and working together with them towards realizing the Program.

Realization of National projects will take place in such focus areas as:
- projects focused on ensuring effective realization of the program and providing both methodological and technical support;
- projects focused on the realization of concrete anti-corruption activities on a national level;
- projects focused on improving anti-corruption laws;
- forming of social partnership between various sectors of society in order to resolve the problem of corruption.

The most important spheres of activities as expressed by the program participants are:
- municipal and national authority structures;
- business;
- educational system;
- law enforcement organs;
- court system;
- medical and health care;
- taxation sphere;
- mass media.

5. Essence of the Program


The Program is composed of two parts:

1) Realization of a comprehensive series of planned activities:

Comprehensive series of planned activities will take place through a systematic structure of cooperation between a series of NGOs from all regions of Ukraine.

The realization of a comprehensive system of planned activities is foreseen as part of the creation and realization of a required series of determined projects in all regions of Ukraine and a separate series of nationwide projects. These projects are being realized based on a separate methodology that is based on the following:
- previous experience of NGOs in Ukraine;
- analysis of pilot projects;
- consultation with leading international organizations (Management Systems International, Transparency International and others);
- experiences gathered from other similar programs;
- recommendations and experience from foreign partner organizations in Central and Eastern Europe;
- proposals of organization-participants of the Program;
- through the evaluations and recommendations by experts.

All projects are realized and agreed upon in regard to plan and within the framework of a single system.

Projects are realized by local NGOs.

The participation of individual NGOs in the realization of a separate component or project is done either through agreement between organizations or tendering out the project.

Different organizations can take on different aspects of the planned out tasks. The number of NGOs that are participating in the realization of the planned activities is in no way limited.

2) Series of Separately Realized Projects (Appendix 3)

Separate projects are realized on the initiative of separate NGOs coexist within the framework of the Program on the basis of cooperative information exchange, cooperation and coordination in their realization.

The idea, time-period, and plan of realizing these projects and the mechanism of cooperating with other participants in the Program are decided upon by the organization-initiator themselves.

All products and materials that are created in the framework of such projects can be distributed through the network of regional NGOs that are taking part in the realizing of the comprehensive system of planned activities.

NGOs that are realizing separate projects take it upon themselves to cooperate with others within the framework of the Program.

Results of activities and information on the realization of projects should be disseminated through the informational network of the Program.

Reciprocal Obligations of the Participants of the Program

In order to develop a strong positive image of the Program and receive the support from society participants of the Program it is needed to take on a number of obligations that include:
- using the symbols and logos of the Program in all their activities that are being conducted within the framework of the Program;
- program participants must exchange information on their activities and projects of their organizations, and when particular activities will take place;
- to provide periodic general information on the activities of the organization to the Executive Committee of the Program, which is obligated to ensure a general Public Relations campaign for the Program;
- to uphold the principles outlined in the Memorandum on Cooperation in the Framework of a National Anti-Corruption Program and the Declaration of the “Freedom of Choice” Coalition;
- to ensure that all activities within the framework of the Program include a large informational component.


Form of the Program’s Realization

The realization of the Program foresees the formation of a united mechanism for cooperation between groups of organizations and their projects within the framework of a systematic mechanism. In addition it is foreseen that there will be separate projects that are agreed upon and are coordinated within the framework of the Program.


6. List of Activities


It is foreseen that under the conditions of the complexity of supporting the NAP or its separate components, organization-realizes for all the listed projects will be selected on a competitive basis.

Regional Projects:


The realization of regional projects of NGOs that are part of the basic list of activities of the NAP foresees a systematic realization of cooperative activities in all regions of Ukraine. The proposed activities will be realized using a single decided upon methodology, that will allow us to create an effective model of realizing the Program, to achieve concrete indicators both quantitative and qualitative, and to conduct continuous monitoring in order to take appropriate corrective measures in the realization of the activities.


Civil Advocacy Office

The activity of a Civil Advocacy Office (hereafter CAO), foresees the provision of professional legal services and of legal defense for persons that experience pressure from corruption or have taken a stand against corrupt activities. It is foreseen that the workers of the CAO are qualified barristers or lawyers, and are activists in the local NGO organization-participant of the NAP.

An important area of work of the CAO will be defending the rights of journalists that are facing pressure. This accent provides the possibility to support in essence the development of independent mass media and to ensure the cooperation of the mass media in the Program. A main task of such an area of activity is the creation of the resonance of precedence; when a person, that openly stands against corruption have the support of the civic sector and wide echo of the affair. Won cases are widely echoed both in local and national mass media.

The main task of the CAO will be to create a level of trust in citizens where there is possibility of success in the protection of their interests using the law. An important aspect of the activities of the CAO is the public nature of its activity and the creation of an atmosphere of a citizen’s movement against corruption.

Cooperators: For successful activity of the CAO it is necessary to put into place professional cooperation with the mass media and the Anti-corruption press center. It is important that the results of the CAO’s regularly and directly make its way to the civil service on all levels.

Executors: Local NGOs, participants in the NAP (for example Union of Consumers Rights, Organization for the Protection of Human Rights, Union of Lawyers, Barrister’s etc.) will be the executors of the CAO’s.


Transparent Government

The main task of the Transparent Government, (hereafter TG), is the systematic multifaceted public illumination of the activities of municipal organs of government and civil servants.

An important function of TG is the cooperation with the organs of local government and disseminates new methods of work, which are within conditions of a democratic society.

We include provision of consultation, finding contacts for information and materials in order to interest the civic service, coming to agreement on cooperation with international partners. The format of the work of TG is the organization of educational program, seminars, round tables dealing with problematic issues and public illumination.

Obligations of the activities of TG include:
· organization of regular public hearings on actual problems effecting the development of the local community.
· organization of Citizen “budgetary hearings” during the time that the municipal budgets are being formed and decided upon.

Cooperators: An incredibly important aspect of this work of TG is the cooperation with the municipal organs of government. In order to do this, local NGOs will employ evident experience and experience from previous cooperation. The Memorandum on cooperation of the Program and the Government of Ukraine and respective part should ensure separate support of cooperation of TG with municipal organs of government for local Governments of municipal authority structures. In context the general informing on the work of TG will be taken care of by cooperation with the mass media.

Within the framework of the activities of TG it is foreseen that there will be close cooperation with the International Renaissance Foundation, that is the initiator of the process of creating TG.

Executors: Local municipal NGOs organization-participants in the Program, those that specialize in the area of consulting, analysis and public education spheres and work in all regions of Ukraine.


Section of Citizen Services

The idea of a section of citizen services has as its basis the problem of the lack of information that citizens have in regard to the function and obligations of acting government organs and organizations as well as about their rights in their relationships with them.

One of the most important reasons for corruption is the lack of information that citizens have about their rights, and thus the improper use of authority and position of authority by certain bureaucrats. Citizens often become the objects of corruption only because they do no have enough information on the restrictions and limitations or obligations and norms of work for particular civil services.

Another particularly important mechanism of corrupt incidents is the direct contact of bureaucrats with citizens in their fulfilling their professional obligations. Existing world practice shows, the further removed that a person who has government authority is from the end user the more objective the activity of the bureaucrat can be and the mechanism makes it more difficult to conduct corrupt practices.

The basis for this service is the creation and distribution of shields/placards on the norms and tasks of each individual government office and a write up on the legal mechanism and procedure for settling disputes. In the framework of the activities of this Service print educational-informational materials can be distributed concerning this subject.

The main task of the Service is informing the public on the obligations and functions of all civil servants and to inform citizens on their rights and possibilities in dealing with government structures.

Cooperators: The activities of the Service are quite extensive in themselves, thus cooperation with government organizations and mass media is an important factor in improving the effectiveness of this work.

Executors: Regional NGO’s organization-participants will realize this part of the Program.



Institute of the Ombudsman

The implementation of the project will include the implementation of the European system of human rights protection. We foresee the establishment of Ombudsman Institute based on local NGOs.

Cooperators: The activities of the Institute of Ombudsman will be conducted in co-operation with state authorities, MPs, and mass media.

Executors: Regional NGO’s organization-participants will realize this part of the Program.



Informational Consultative Citizen Reception Rooms

The activity of Citizen Reception Rooms, (hereafter CRR), is one of the supporting components of the realization of the Program, in as much that in ensures the collection of information and a full spectrum information services for citizens in relation to the problem of corruption.

The basis of activities for the CRR’s is the constant provision of private and telephone consultations for citizens on their rights and mechanisms of solving a problem related to corruption.

Separate functions of activities of the CRR’s are:

· dissemination of print materials and other materials that are being published within the framework of the NAP or through the mass media, NGOs in the regions, volunteers and other interested organizations;
· put out daily press releases on the basis of their own activity and realization of other projects for distribution to the mass media and other interested organizations;
· preparation of weekly reports on the activities of the organization-participants of the Program in their region, for use by the national press center of the NAP, distribution of materials in national publications;
· cooperation with journalists who are conducting research;
· organization of regular press conference to illuminate the activities of the Program in their region and for the popularization of the ideal for which they are being realized;
· organization of educational and informational activities for specific organs of state and state organization as well as for groups of citizens.

P.S. To the list of projects that are being realized within the framework of the Program other individual projects that answer the specifics and needs of a region can be added.


National Projects:



Anti-corruption Press Center

Realization of this project foresees the creation of a regularly functioning information service, that will:

· using the example of the “Hot Line” daily create a news bulletin on the anti-corruption theme. The bulletin will be distributed via e-mail to 600-800 regional and national mass media and will be placed on the Program’s web-site at www.anticorruption-ua.org. The bulletin will be drawn from our own network of correspondents, activities in the regions and additional information.
· create regular monthly press conferences in regard to the progress of the NAP, to illuminate the resonance of events and other activities that are related to anti-corruption activities;
· organize journalistic researches and active cooperation with journalists who are working on similar topics;
· disseminate analytical, social and research materials amongst representatives of the government authorities, Parliament, mass media, business and others.

Cooperators: Regional informational-consultative centers; Government and Parliament; Independent mass media.

Executors: Organization-participants of the Program with experience in the sphere of media.


Website

Functioning of an official website of the Program that will concentrate on providing information and any experience and mechanisms of anti-corruption activities. Operatively and clearly display all news and activities of the NAP and will include:

· library of thematically related materials;
· analytical and sociological materials;
· contact information of all participants of the NAP, Ukrainian and international partners
· information on the function and obligations of all civil services and structures
· all publications and materials published by participants in the NAP and organization-partners;
· description of the NAP and the mechanism for its realization
· mechanism of participation in the work of the Program.

Cooperators: Regional informational-consultative centers, Anti-Corruption Press Center, Executive structure of the Program and others will work providing information for the site.

Executors: Organization-participants in the NAP with experience in the support of similar websites.


National Newspaper and Print Materials

The aim of the project is to come to an agreement on a regular mechanism of information the population concerning the work of the NAP and the creation of an active mechanism to influence public opinion.

Tasks of the project:

· illuminating the real state and manifestations of corruption;
· creation of an independent active mechanism to influence public opinion;
· illuminating the result of investigative journalism that precedents of successful anti-corruption activities;
· illuminating the work of the NAP;
· formation of a negative public opinion in regard to corruption;
· publication of regular journalistic research, materials and facts about corruption;
· providing citizens of Ukraine with information concerning their rights.

Foresee making available materials published in the press available on the Internet.

An important element is the availability of this material through free distribution to representatives of national and regional government structures, businesspeople, and NGOs.

Executors: Organization-participants in the NAP with experience in similar activities.

 

Analytical publications for decision-makers (politicians, civil servants and business people)

The aim of the project is the formation of negative attitude towards corruption and ensurance of transparency in business, governmental structures, political parties, unions of entrepreneurs and lobby structures.

Tasks of the project:

· formation of a negative opinion in regard to corruption in the elite sector;
· illuminating of advantages of transparency of lobbing, open competition and transparency of the decision-making process;
· illuminating the real state and manifestations of corruption in the decision-making process, in privatization, conducting of tenders, formation and execution of budgets at different levels, and regulation of business activities;
· illuminating the work of the NAP;
· publication of regular journalistic research, materials and facts about corruption;
· providing consultations for business in regard to questions of taxation, licensing, participation in the tender process and privatization, formation and execution of municipal and state budgets;
· calculation of costs of corruption for business by conducting regular expert survey of Ukrainian and foreign businessmen.

We foresee making available materials published in the press available on the Internet.

The main idea of this publication of material is to provide information on the NAP via free distribution to representatives of national and regional government structures, businessmen and NGOs.

Executors: Organization-participants in the NAP with experience in similar activities.


Center for the Problems with Legislation

Cooperation of Parliament and NGOs in the area of improving anti-corruption legislation is important area of focus of the Program. In the environment of the “third sector” some time ago there was formed a group that effectively works on the problem of improving legislation and effectively influence the decision making process. With this goal in mind a systematic analysis of the current anti-corruption legislation will take place, joint expert groups of NGOs and Parliament will be formed to discuss the mechanism of improving the said legislation and related analytical notes will be prepared.

Organization-participants of the NAP coordinate this activity and organize the cooperation of interested parties.

Cooperators: All organization-participants of the NAP and partners that are working in the sphere of analyzing legislation and education and support of professional activities of organs of state authority, Parliament and Government of Ukraine will cooperate in this aspect of the Program.

Executors: NGO (Analytic Center) participant or partner of the NAP will realize this aspect of the Program.

 

Anti-Corruption Monitoring

The goal of this project is to monitor and inform society and the government about threats of corruption that exist in governmental decisions or in their projects.

Tasks of the project:
· organization of civic monitoring and realization of government decisions and legislative acts of Parliament in view of their influence on either increasing or decreasing the possibilities for corruption;
· increase awareness of the possibilities of corruption, that are results of decisions of government;
· elaboration of proposals regarding decreasing the potential for corruption in proposed and existing legislative acts;
· organization of civic monitoring of decisions taken municipal governments in view of their influence on either increasing or decreasing the possibilities for corruption.

Cooperators: All organization-participants of the NAP and partners with experience in the area of analysis of government activities, Parliament and Government of Ukraine

Executors:
NGO (Analytical Center) participant of the NAP


Ukrainian System of Integrity

The goal of the project is to adapt a handbook of USAID and Transparency International “National System of Integrity”.

Tasks of the project:

· adapting handbooks and aids of USAID and Transparency International “National System of Integrity” for Ukrainian conditions and develop a national handbook;
· draw attention to respective officials and of society to “best practices” of anti-corruption programs of the world;
· elaboration of a national aid “Ukrainian System of Integrity”.

Cooperators: All organization-participants in the NAP and partners who work in the area of anti-corruption, (USAID, The World Bank, Transparency International, Management Systems International etc.)

Executor: NGO (Analytical Center) participant of the NAP


Transparent privatization and governance

The goal of the project is to ensure the transparency of privatization and the reassignment of management of Ukrainian enterprises and municipal ownership.

Tasks of this project:

· increasing of public trust for conducting the privatization and the reassignment of management;
· analysis of international experience and Ukrainian practice of privatization and the reassignment of management of Ukrainian Industrial complexes and the possibility of corruption;
· development the criteria of evaluating the possibility for corruption;
· conducting regular monitoring of the process of privatization and the reassignment of management of Ukrainian Industrial Complexes and municipal ownership;
· informing the population about the facts of corruption and/or the possibility of corruption;
· development of efficient and transparent procedures on informing the population on conditions of privatization and reassignment of Ukrainian Industrial Complexes and the control over the execution of obligations;
· development of procedures and recommendations in regard to the avoidance and preventing corruption;
· conducting of educational campaign amongst businesspeople, civil servants, journalists and society in order to ensure the transparency of procedures in regard to privatization and the reassignment of management of Industrial Complexes.

Transparency in Budget Process

The goal of the project is to ensure transparency in the process of and execution of state and municipal budgets.

Tasks of the project:

· increasing of budget costs effectiveness;
· analysis of international experience and Ukrainian practice in the formation and the execution of municipal budgets;
· developing the criteria of evaluating the possibility for corruption;
· conducting regular monitoring on the formation and executions of municipal budgets;
· informing the population about the facts on corruption and or the possibility of corruption;
· developing transparent procedures of informing the population on conditions of formation and execution of municipal budgets;
· development of procedures and recommendations in regard to the avoidance and stemming corruption;
· conducting educational campaign amongst businesspeople, civil servants, journalists and society in order to ensure the transparency of procedures in regard to the formation and execution of municipal budgets.

Transparency and deregulation of the Ukrainian market

The aim of the project is to ensure the transparency and deregulation of the Ukrainian market.

Tasks of the project:

· increasing of trust of foreign investors, Ukrainian business, Government and free-trade unions in regard to rules of the market;
· analysis of international experience and Ukrainian practices in deregulation, and increase of transparency of the market;
· conducting regular monitoring of the decision-making process, state authorities on national and municipal levels;
· informing public on facts of corruption or possibilities of corruption related to non-transparency and over-regulation;
· elaborating of transparent procedures on informing businesses and the public about changes to the rules of the market;
· elaborating of procedures and recommendations on avoiding and stemming corruption;
· conducting awareness campaign for businesses, civil servants, journalists, and the public aimed at supporting transparency and deregulation.

Transparency Taxes Paying

The aim of the project is to inform the public on tax system and ensure transparency of the decision-making process by State Tax Administration (STA).

Tasks of the project:

· increasing of public awareness in regard to the taxation system and decisions within the system;
· regular monitoring of decisions of STA and municipal authorities;
· elaborating of transparent procedures for informing businesses and the public concerning changes in taxation.

Transparent Politics

The goal of this project is to increase the level of transparency in the functioning of political parties and election campaigns.

Tasks of the Project:
· increasing the level of information available to citizens of Ukraine in regards to the sources and breadth of financing of political parties and election campaigns;
· formation of transparent procedures for financing;
· formation and encouragement of public declaration of all sources of income of politicians and members of their families.

Fair Competition

The aim of the project is to increase the role of open market mechanisms (stock-exchanges, tenders, etc) as well as increasing of their openness and transparency.

Tasks of the project:

· increasing the role of tenders and stock exchanges as instruments of reducing corruption;
· increasing of trust of foreign investors, Ukrainian businesses, Government, and trade unions towards open market mechanisms;
· analysis of international experience and Ukrainian practice in regard to tenders and stock exchanges;
· conducting regular monitoring of transparency of tenders and stock exchanges;
· elaborating transparent procedures for informing businesses and public on the conditions for organizing tenders;
· conducting educational campaign among business people, civil servants, journalists and society in order to ensure the understanding of the necessity to increase the role of tenders and stock exchanges in the process of reforms.

Anti-Corruption Rating

The aim of the project is to favor and ensure the publication of journalist research and of high-quality analytical materials in the national and regional press, on TV and radio, which will assist in changing of public opinion and attitudes towards corruption within the society.

Conduct a rating of the best materials with an anti-corruption theme printed in the press, broadcast on TV and radio in order to stimulate journalists to research the facts of corruption and to write exposes dedicated to the negative effect corruption has on society. Foresee the monitoring of information sources, organization of expert questionnaires, conducting a series of seminars for journalists and a contest for journalists writing on this theme, advertising it and its results in the mass media, conducting a public event for the awarding the winner of the prize.

Informational-Consultative Center for Businesspersons

Foresee the provision of consultative services via a network of CRR’s, conducting seminars and distribution of educational literature, (payment of taxes, authority of controlling organs etc.), conducting of activities focus on greater transparency of procedures in regard to the decision making process by state organs, informing the population about the facts on corruption, that are related to business.

Executors: Organization-participants in the NAP, which have experience in this area, will realize this aspect of the Program.


Informational and Consultative Service for Civil Servants

The goal of this project favors the carrying out of administrative reforms in Ukraine through legal education of civil servants.

Tasks of the Project:

· learning the world experiences of administrative reforms in Ukraine through legal education of civil servants;
· educating civil servants in regard to the cost of corruption;
· informing civil servants on the facts of corruption within government and the punishment for it.

 

Executors: Organization-participants in the NAP, which work in this area, will realize this aspect of the Program.


Anti-Corruption Index

Within the Program, an Anti-Corruption Index will be created. The index will estimate the level of corruption in different spheres of society. The index will be based on monitoring, sociological and expert indicators. The project will be implemented with participation of state authorities, which could result in regarding the index as national index of corruption in the country.

Sociological Research and Surveys

Organization of sociological analysis, surveys, and research oriented for journalists, analysts, politicians, experts, and a wide range of society. The project foresees the organization expert surveys, focus groups, and content analysis of the mass media, public opinion surveys, round table discussions, press conferences, and conferences on the Internet. It foresees discussion on the Democratic Initiatives Foundation website, cooperation and informational exchange with other Ukrainian projects in real time.

Executors: Organization-participants in the NAP, which have experience in this area, will realize this aspect of the Program.


Educational materials

The realization of the project foresees the realization of a series of informational-educational brochures, which illustrate the essence of corrupt activities in concrete terms, with clear explanation and recommendations of how to deal with the problem.

The themes of the brochures can illustrate the following problems:

· dealing with organs of state authority;
· dealing with law enforcement organs;
· the sphere of medicine;
· the sphere of education;
· the Court system;
· state automobile inspection etc.

The style should be straightforward, and easy to follow using and sellable, meaning attractive to the end user.

Executors: Organization-participants in the NAP, which have experience in this area, will realize this aspect of the Program.


Social Partnership

A particularly important area of focus in the activities of the Executive Committee is the formation of a social partnership between NGO organization-participants in the Program and representatives of state organs, business, free trade unions, and the mass media. The creation of an effective model of such a partnership in the context of supporting general reforms will ensure many times over the effectiveness of the Program.

The main idea of the project is the creation of systems of cooperation and the conducting of regular expert meetings between representatives of state organs, Parliament, business, mass media representatives and the civic sector.

Materials and expert notes of these meetings will be distributed through the informational system of the Program.

Project on the Codification of Moral and Ethical Principles of Activities

Realization of this project foresees the preparation and creation of a series of codexes for different spheres of activity: society, administration, and legal, court system, NGOs, business and so forth.

The mechanism for the realization of this project is the analysis of analogical documents, the collection and systematization of proposals, and the conducting of consultative events.

The result of the realization of the project is the formation of a series of laws, particularly: Codex on the Behavior of Civil Servants; Codex on the Behavior of Deputies of Parliament; Codex on the Behavior of Lawyers; Codex on the Behavior of Journalists; Codex on the Behavior of Businesspeople; Codex on the Behavior of NGOs.

Cooperators: Representatives of the respective parts of society will cooperate on this project.

Executors: Organization-participants in the NAP, which specialize in specific spheres of activities.



Social Advertising on Radio and Television

The successful realization of all activities of the Program foresees the tight cooperation with the mass media. Effective and practical activities of organization-participants of the NAP will ensure a quality foundation of influence on the general attitude of society to the problem of corruption, which is the main task of the Program.

For this reason, an effective comprehensive of Public Service Announcements on radio and television could have a significant influence on citizens. With this method, we foresee the creation of a series of radio and television PSAs that will be broadcast by radio and television companies that will be cooperating with the NAP and the leading national companies.

In the framework of the NAP it is proposed to create a block of 10 PSA of 30 seconds each that will in stages be broadcast over an 18-24 month period.

Executors: Organization-participants in the NAP, which have experience in this area, will realize this aspect of the Program. Successful executors of this type of work can be partners of the NAP, for example INTERNEWS-Ukraine, or the Ukrainian Independent Center for Policy Analysis.

 

Talk Shows on Radio and Television

An important influence on the attitudes of citizens to the problem of corruption is the creation of popular talk shows on radio and television. Analysis of effective similar events shows that they are popular among citizens. The main important thing is that their organization and broadcast of these shows has a systematic and regular character and is produced on a professional level by professionals, who have experience in similar areas of work and the possibility of widely broadcasting the finished product.

In order to realize this task we propose a monthly broadcast on the leading radio and television stations on the theme of anti-corruption with the participation of specialists and common citizens.

 

Executors:Organization-participants in the NAP, which have experience in this area, will realize this aspect of the Program. Successful executors of this type of work can be partners of the NAP, for example INTERNEWS-Ukraine, or the Ukrainian Independent Center for Policy Analysis.


Creation of an Informational Television Program

Creation of television programming that has as its main theme actual themes on the cost of corruption, the problem of post-totalitarian thought and attitude towards corruption, ethical problems of working in a democratic society and so forth.

The television shows must be dynamic in character and show concrete examples in the day-to-day life of society.

This foresees that the maximally effective method of doing this would be a monthly production of a television program and its broadcast on the best-rated television stations. Later the product can be distributed free of charge to regional television company partners of the NAP.

Cooperators: Distribution of the television programs will take place through the regional organizations of the NAP, and the television companies in the INTERNEWS-Ukraine network and Teleradiokurier.

Executors: Organization-participants in the NAP, which have experience in this area, will realize this aspect of the Program. Successful executors of this type of work can be partners of the NAP, for example INTERNEWS-Ukraine.


Monitoring the Program

Regular monitoring of the Program’s realization is an important follow-up to its successful realization. Therefore, it is very important to find the right organization, which could constantly conduct monitoring both regularly and on a stage-by-stage basis of its key indicators.

Executors: It is important that the organization that conducts this monitoring not be a participant in projects of the NAP, or a partner.


Ensuring the Organizational Realization of the Program

For successful organizational cooperation, and the comprehensive realization of the Program it becomes necessary to create a system and organization to ensure its realization. With this in mind it is foreseen that monthly meetings for coordination for organization-participants of the NAP be held, to which representatives of each region where the NAP is taking place will be invited, the directors of national projects and a representative of the Executive Committee of the Program. All meetings will be open.

For the regular systematic assurance of the activity of the program, the organization-participants of the NAP create from their membership within the framework of the Secretariat of the Freedom of Choice Coalition an Executive Committee of the NAP. The Executive Committee will:

· execute the decisions of the Coordinative Council of the NAP;
· conduct the coordination of all organization-participants in the NAP;
· conduct systematic distribution and information exchange;
· represent the NAP before partner organizations;
· publish a weekly bulletin;
· prepare reports on the activities of the NAP.

Formation of the Coordinative Council of the NAP and the Executive Committee of the NAP and also the approval of their work plan will take place at a general conference of the organization-participants of the NAP.

Particularly important is the focus of activities of the Executive Committee to form social partnership between NGO participants of the NAP and representatives of government organs, business and mass media. Creation of an effective model of such a partnership in the context of supporting general reforms will ensure many times over the effectiveness of the Program.

Executors: “Freedom of Choice” Coalition Secretariat organization-partners of the NAP will realize this aspect of the Program.


Methodological Assurance of the Program

Considering the wide scale nature of the Program, the tasks and number of organizations that are participating in the NAP there is a need for constant analysis of the effectiveness of the work of the NAP, conducting of related monitoring and the development analytic recommendations in regards to the realization of the different projects.

The necessity of this is particularly important for the success of the networked projects in the regions of Ukraine. Particularly important is the analytical assurance of the realization of the Program is the regular use of new technologies, which are required under the conditions of such complex analysis of work.

Cooperators: All organization-participants in the NAP, the Executive structure of the Program, donors and partner organizations will realize this aspect of the Program

Executors: One or a group of analytical centers participants in the NAP will realize this aspect of the Program.


Separate Activities Within the Framework of the Program

1. Creation and signing of a Memorandum on the Cooperation between the NAP and the Government;
2. Conducting a Conference of the organization-participants of the NAP;
3. Conducting a seminar on the problem and on a social partnership;
4. Conducting an educational-practical conference for civil servants with the goal of determining and discussion of the main problems and sources of corruption and the methods to resolve them;
5. Conducting an international conference in order to learn and adapt the experiences of the anti-corruption activities of the Program.


7. Working Plan of the Program



Stage 1 – Preparation

December 1999

The Secretariat of the “Freedom Choice” Coalition polled members of the Coalition on what they consider to be the most important problems in Ukrainian society. 45% named the problem of corruption.

January-March 2000

The initiative group has identified a temporary Working Group for the preparation of the Program.

The Working Group informed NGOs throughout Ukraine about the initiative on trying to realize the Program and about possible partners and prepared the Concept of the Program (hereafter, Concept).

Over a two-week period, from the time the initiative was announced, the Working Group gathered a list of initiatives, projects and ideas that were submitted by interested organizations.

On the basis of the gathered initiatives, the Working Group began to develop a comprehensive plan of activities for the entire timeframe of the realization of the Program and prepares projects.

The Program goes through a registration process that is in accordance to the procedures outlined in the Statement on the activities of the “Freedom of Choice” Coalition.

April-October 2000

Conference of participants in the NAP was held. The NAP project as presented at the conference was accepted as a basis for further further work and development. The composition of the Working Group was ratified.

Official website of the NAP was created www.anticorruption-ua.org.

Three issues of the “Anti-Corruption Bulletin” were published in Ukrainian and English (Newsletter of the working group of the NAP).

The NAP was improved on the base of the experience and feedbacks of the World Bank, Management Systems International, Transparency International, International Development Law Institute (IDLI), Bulgarian Coalition 2000, The Parliamentary Committee on the Question of Fighting Organized Crime and Corruption, and Parliamentary Committee in Regards to the Question of Legislative Ensurance of Law-Enforcement Activities.

NAP members are being realized over more that 40 anti-corruption projects.

October 20-21, 2000
The International Seminar “National Anti-corruption Program: International Experience for Ukraine” was held. The main goal of this seminar is to analyze foreign experience and to adapt it to Ukrainian reality.

The official start of the Program was announced.

At present moment more than 125 organizations from all regions of Ukraine are member-participants of the NAP. We are looking forward to acquiring new members.


Stage 2 – Starting
November 2000 – January 2001

At this stage the NAP projects will be examined, Public Relations Campaign for the start of the Program will take place and the methodology and mechanism for the realization of the Program will be worked out.

The Coordinating Council and Executive Committee of the Program are formed, elaboration of procedures of cooperation between organization-participants of the Program are developed.

Agreements are reached between organizations that have shown an interest in participating in the realization of the Program with the goal of determining the executors of specific projects at both regional and national levels.

Discussions and consultations are held regarding cooperation in the framework of the Program with government, state, business, professional and donor structures.

Search for resources is undertaken for the realization of the Program as a whole and for its individual components.

Conference of the participants of the NAP is held.

The system and mechanisms for cooperation of Program participants is finalized.

At the end of this stage of the Program a conference for the participants will be held in order to analyze and to summarize the events of the last four month period, to discuss an effective mechanism for the realization of the Program and for further coordination of the activities of the participants.


Stage 3 - Main
February 2001 - December 2003

The comprehensive practical activities will be take place in order to realize the projects that make up the Program.


Stage 4 - Final
January 2003 – Marth 2003

A summarization of the Program will be done based on a number of quantitative and qualitative measures.

Discussions will take place to identify the perspectives of continuing the Program in future.

A final Conference will held for the participants in the Program.

During the Entire Period that the Program is Being Realized:

- activities will take places that focus on the formation of a system of social partnership between different sectors of society in order to address the problem of corruption;
- constant improvement on the methodology of cooperation between participants of the Program and in the realization of the projects that are being realized within its framework.


8. Desired Results


Realization of the Program is to have a varied resonance: political, economic, legal, organizational-management, and socio-psychological character.

Political

· Formation of a block of citizen strengths that initiate and constantly activate national and civic activity, in relation to the battle with corruption;
· Ensure the transparency of financing of political parties and electoral campaigns;
· An increase in the understanding of citizens and an increasing in their participation in the battle with corruption;
· An active engagement of working collectives in regard to the control and conformity to anti-corruption laws, creation of activities in regard to stemming corrupt activities and their public discussion;
· Passing of laws and normative-legal acts, that will insure the transparency of the financing of political parties and NGOs, and also election campaigns;
· Passing of Codices of Behavior for individuals, elected to office, and publicly signed by them.

Economic

· Passing of laws and normative-legal acts, that will improve and clarify the taxation system in order to decrease the pressure of taxes on businesspeople;
· Create within Ukraine an environment of natural competition;
· Conducting effective procedures to engage society in the budgetary process;
· Increase the level of foreign private investment in Ukraine’s economy;
· Increase the level of internal investment (particularly through the savings of Ukrainian citizens in Ukraine’s banks);
· Creation of a system of citizen control of the use of state property;
· Creation of a system of reporting, registration and audits of business structures;
· Creation of a system of openness for call for tenders and the assurance of fair conditions for all participants;
· Simplify the system for licensing and decrease its sphere of necessity.

Legal

· Improvement of legislation for the protection of human rights from corruption and improvement of legislation in regard to the abundance, and direct and stable regulation in business, agriculture, financial and banking-credit relations;
· Improvement of court practices in regard to the examination of complaints before the courts, of activity or inactivity of state organs of authority, organs of municipal self-government, appointed and civil servants;
· Put in place a system of citizen expertise on projects of law and other normative-legal acts specifically aimed at anti-corruption;
· Creation of a system of guaranteed protection for those who have suffered and witnesses, workers of the mass media and others, that are trying to reveal corrupt activities.

Organizational-Administrative

· Determining different branches of national leadership and management (first of all those, that can be considered the most corrupt based on the data of a sociological survey); their work activities, operative, decisions, in the possibility of revealing perpetrators of corrupt activities, development of a proposal regarding the conditions and procedures in order to be able to reveal these facts;
· Informing the public on the standards and procedures and rules of decrees and permissions, the issuing of official documents, the solving of other questions in regards to their person;
· Putting in place a single general rule (condition) of applying for work, guaranteeing their upholding;
· Preparation of a codex of behavior of civil servants, a codex for law enforcement organs, codex for the fairness of the courts, the organization of their acceptance and public signing.



Socio-psychological

· Increasing the level of knowledge and educating different sectors of the population in regard to their role, their path and form of the development of institutes of a civic society, integrity in the relations between the state and the population;
· The formation of a negative attitude of the population in regard to corruption, participants in corrupt acts, and their conditions, and creation of patriotic motivation of wanting to stem corruption and the revealing of facts in regard to perpetrators of corruption;
· Formation of public opinion concerning the unpleasantness, and detrimental effect of corruption, and the active participation of the population of stemming and self will of reducing corruption.


9. Program Monitoring and evaluation


Constant monitoring in regard to meeting targets set out in the realization of the Program is an important aspect of ensuring its success.

Within the framework of the realization of the Program, specific monitoring will take place in regard to the realization of the Program, and in addition analysis of each stage of realization will be conducted.

10. Perspectives of SUSTAINABLE development

The period of practical realization of the Program is based on the conditions and dynamics of political, democratic, socio-economic and legal development of Ukraine and the formation of civic society during this transitional stage of development. A great deal depends on the activities of all state organs, political participants and the civic sector on a generally national and regional levels, the attitude to the problem on the part of the state and of its citizens.

The realization of the Program will not eliminate corruption as a phenomenon, but will create the conditions for successfully combating it in the future.

Based on achievement of the desired results, gained experience, and substantial conditions for economic, political, and social development and the transformation of the Program, will depend on the practical results of its realization.


11. Program Structure


The structure of the Program is made up of five blocks, each of which plays an important role in the achievement of a positive result. They are:
1. block or regional projects;
2. block of national projects;
3. system of Social Partnership;
4. separate Activities of the Program;
5. organization, cooperation and administration of the Program.


Coordinative Council and Executive Committee of the Program

At the Conference of representatives of the organization-participants of the Program Coordinative Council was formed along with an Executive Committee

Coordinative Council of the Program:
· formulates strategy and tactics of the Program;
· coordinates the work and focus areas of the Program;
· coordinates the conducting of national and regional projects;
· approves the reports on the realization of projects.

Executive Committee of the Program
· executes the decisions of the Coordinative Council;
· realizes the coordination of act ivies of all organization-participants of the Program;
· ensures a systematic distribution and information exchange within the environment of the Program;
· represents the Program to partner organizations;
· realizes the publication of a weekly bulletin of the Program;
· prepares reports on the realization of the Program.

Corruption in the world monetary-financial markets and its influence on corruption in banking, manufacturing and business sectors of the Ukrainian economy

Aim of the Project

1. To learn about the potential for corruption in the world monetary-financial markets and their influence on corruption various sectors of Ukraine’s economy, mainly banking and financial markets.
2. To develop procedures and recommendations aimed at stemming and anticipating corruption in the banking, manufacturing and business sectors of the Ukrainian economy.

The project will analyze the main development of current monetary-financial systems, the reasons and consequences of the asian crisis of 1997-98, that have were a foreward to the increase of corruption and money laundering in the world, the role of international financial institutions in resolving corruption in the world and in Ukraine. The project will attempt to explain the relationship that exists between corruption within monetary-financial markets and Ukrainian corruption, the elaboration of procedures and recommendations aimed at stemming and anticipating corruption in Ukraine.

3. CITIZEN CONTROL OVER CORRUPTION

Publication and Dissemination of National Print Periodical Newspaper

Aim of the Project

Preparetion of regular mechanism for informing the public in regard to the National Anti-Corruption Program and to create an active method of influencing public opinion.

Tasks of the Project
· publicizing the work of the National Anti-corruption Program;
· creating a negative public opinion in regard to the phenomenon of corruption;
· publishing regular journalistic research and materials on the facts of corruption;
· through employing the press providing citizens of Ukraine with advice in regard to their rights during their interaction with state authorities;
· making the materials of the newspaper available on the Internet.

Executors
The Center for the Forecasting of Socio-Economic and Political Processes and the Communications Development Center will be the primary executors of this project.

Aim of the Project

To conduct a rating of the best materials on the theme of anti-corruption in the press on television and radio in order to stimulate journalists conduct investigative reports on the facts of corruption and to write materials that will help create a negative public opinion concerning corruption.
